Welcome to Top Chartered Worldwide Limited (TCWL Investments). These Terms & Conditions (“Terms”) govern your use of our services, including Forex, Commodities, Cryptocurrency trading, AI-powered analytics, Portfolio Management, Wealth Growth & Capital Protection Program, and Institutional & HNI Advisory (collectively, “Services”). By accessing our website, engaging with our team, or entering into an investment agreement, you agree to these Terms. If you do not agree, please do not use our Services.

1. Parties and Agreement

  • Parties: This agreement is between TCWL Investments (including affiliates like Parakala Crude Ventures OPC Pvt. Ltd.) and you ("Client", "you", or "your").
  • Acceptance: Your electronic signature, email confirmation, or initiation of Services constitutes binding acceptance. We reserve the right to update these Terms; continued use implies acceptance of changes.
  • Eligibility: You must be at least 18 years old, legally competent, and not a resident of restricted jurisdictions (e.g., sanctioned countries per OFAC or equivalent).

2. Services Overview

TCWL provides discretionary or advisory trading Services across Forex, Commodities, Cryptocurrencies, and related assets. Key features include:

  • AI-driven analysis and signals.

  • Risk-managed strategies with capital protection options.

  • Customized portfolios and reporting.

Services are delivered via dedicated relationship managers, secure platforms, and compliant execution venues. We do not guarantee specific returns, though select programs offer principal protection and assured basic returns as detailed in your agreement.

3. Client Responsibilities

  • Provide accurate, complete information for risk profiling, KYC/AML verification, and onboarding.

  • Comply with all applicable laws, including tax reporting.

  • Promptly notify us of changes in financial status, risk tolerance, or contact details.

  • Acknowledge trading involves risks (see Section 7); do not invest funds you cannot afford to lose.

4. Fees and Payments

  • Fees are performance-based, fixed, or hybrid, fully disclosed in your Investment Agreement or Fee Schedule prior to onboarding.

  • No hidden charges; all costs (e.g., trading commissions, management fees) are transparent.

  • Payments via approved methods; minimum investment thresholds apply per client profile.

  • Withdrawals are processed per agreement terms (typically T+2 to T+5 business days), subject to market liquidity and compliance checks.

5. Risk Disclosures

Trading is inherently risky. You acknowledge:

  • Potential for loss of principal due to market volatility, geopolitical events, or execution risks.

  • Forex/Commodities/Crypto involve leverage, liquidity risks, and 24/7 exposure.

  • Past performance does not predict future results; AI tools enhance but do not eliminate risks.

  • We employ risk management (e.g., stop-losses, hedging), but no strategy is foolproof.
    Consult independent advisors; TCWL is not liable for market-driven losses.

6. Principal Protection and Guarantees (Where Applicable)

For programs like Wealth Growth & Capital Protection:

  • Principal guarantee applies to qualifying investments, subject to terms (e.g., lock-in periods).

  • Basic assured returns and profit bonuses are conditional on program performance and compliance.

7. Confidentiality and Data Protection

  • We protect your data with encryption, secure servers, and GDPR/HKPDPO-compliant practices.

  • Information shared only for Service delivery, regulatory needs, or with your consent.

  • You grant us rights to use anonymized data for analytics/AI improvement.

8. Representations and Warranties

  • TCWL complies with Hong Kong, Indian, and international standards (e.g., SFC guidelines where applicable).

  • Services are not FDIC/equivalent insured; we are not banks.

  • You represent investments are from legitimate sources; we reserve rights to suspend for AML concerns.

9. Termination and Withdrawals

  • Either party may terminate with written notice; we process final settlements promptly.

  • Withdrawals allowed per agreement (no lock-ins unless specified); fees may apply for early exits.

  • Upon termination, we liquidate positions at market rates, net of fees.

10. Limitation of Liability

To the fullest extent permitted by law:

  • TCWL is not liable for indirect, consequential, or punitive damages.

  • Total liability capped at your invested principal or fees paid (whichever lower).

  • Force majeure (e.g., hacks, wars, regulations) excuses performance.

11. Governing Law and Dispute Resolution

  • Governed by laws of Hong Kong (or India for Indian clients).

  • Disputes resolved via arbitration in Hong Kong/Chennai under HKIAC/ICDR rules.

  • Prevailing party entitled to costs.

12. Amendments and Severability

We may amend Terms with notice (email/post). Invalid provisions do not affect others.
